Privacy Policy and Terms of Service
PRIVACY POLICY
1. Information we collect
Digital Tax Compliance Operations, LLC (“DTCO,” “we,” “us,” or “our”) may collect business and contact information, website-use information, cookies, payment or enrollment status, and information a client voluntarily submits. Do not submit Social Security numbers, banking credentials, passwords, tax returns, or other highly sensitive tax documents through ordinary website forms or ordinary email.
2. How information is used
We use information to respond to inquiries, administer assessments, provide and improve services, process enrollment, communicate about engagements, coordinate with authorized practitioners, and meet legal or operational obligations.
3. Service providers and security
DTCO may use Squarespace, Square, Google, scheduling providers, and other service providers subject to their own policies. We use commercially reasonable safeguards, but no internet transmission method is guaranteed completely secure. Secure transmission methods should be used when sensitive documents are required.
4. Choices and contact
You may contact digitaltaxcomplianceop@gmail.com regarding your information or communication preferences. Required service and transaction communications may still be sent as permitted by law.
TERMS OF SERVICE
1. Business identity and acceptance
These Terms apply to digitalconsultsinc.com and services offered by Digital Tax Compliance Operations, LLC. By using this website or accepting an engagement, you agree to applicable terms, the DTCO Client Service Agreement, and any signed scope of work.
2. Services and professional limitations
DTCO provides corporate tax-compliance oversight, audit-readiness support, book-to-tax review, financial reconstruction, practitioner coordination, and related services in the selected package or written scope. DTCO does not provide legal services and does not perform CPA audit or attestation services unless separately and lawfully engaged. Tax-return preparation, bookkeeping catch-up, legal or examination representation, amended returns, and material reconstruction are not automatically included.
3. Client responsibilities and no guarantees
Clients must provide complete, accurate, and timely information and access. DTCO may rely on information supplied by clients and their professionals. No tax result, refund, tax savings, examination result, IRS or state decision, or other outcome is guaranteed.
4. Monthly packages and recurring billing
Foundation is $5,000 per month, Strategic is $7,000 per month, and Executive is $8,500 per month. Each has a three-month initial term, is billed monthly in advance through Square, and requires recurring electronic billing authorization. The first payment is due at enrollment and the payment method must remain current.
If a recurring payment fails, Square-supported retries may occur. The client has five business days after notice to correct the payment. DTCO may pause services after the cure period until the account is current.
5. Custom engagements
Custom Compliance & Financial Reconstruction engagements have a $15,000 minimum and begin with a $7,500 deposit applied toward engagement fees. The remaining balance is billed under the signed scope and payment schedule.
6. Cancellation and termination
After the initial three-month term, a client may cancel monthly services with 30 days’ written notice. Cancellation does not create a refund for a billing period that has begun and in which services have commenced. DTCO may suspend or terminate for nonpayment, missing records, unlawful or unethical requested activity, material breach, abusive or threatening conduct, or circumstances making continued performance professionally inappropriate, with reasonable notice when practical.
7. Refund principles
Payments for services already performed or a billing period in which work has commenced are generally non-refundable, except for duplicate or error payments or where applicable law requires otherwise. For custom engagements, the deposit may be applied to earned fees, work performed, and agreed costs. Unearned balances are handled under the written scope, agreement, and applicable law. If DTCO cancels before substantive work begins, unearned prepaid fees will be returned as appropriate.
8. Scope changes
Material additions involving entities, jurisdictions, transaction volume, reconstruction, examinations or notices, historical years, return preparation, specialized research, representation, or special projects may require a written change order or separate scope and additional fees. A monthly subscription does not require material out-of-scope work.
9. Confidentiality, communications, and electronic signatures
DTCO uses commercially reasonable safeguards for confidential information. Electronic communications, records, and signatures are permitted. Clients should use secure transmission methods for sensitive documents.
10. Limitation of liability and third parties
To the fullest extent permitted by law, DTCO is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages or for losses caused by inaccurate, incomplete, or untimely information supplied by clients or third parties. DTCO may coordinate with independent professionals but is not responsible for their independent acts or omissions. Nothing here limits rights or liabilities that cannot legally be waived.
11. Governing law
These Terms and applicable service agreements are governed by the laws of the State of North Carolina, subject to non-waivable applicable law.
